Introduction These Terms of Service (“Terms”) govern your access to and use of Futago, including our website, applications, AI tools, paid features, generated content, account features, and related services. By accessing or using Futago, you agree to these Terms and to our Privacy Policy. If you do not agree with these Terms, you must not use Futago. 2. What Futago Does Futago is an AI-powered visual content service that allows users to generate, edit, remix, animate, and enhance images and videos. Futago features may include: • image generation from text prompts; • image generation from reference images; • image editing and improvement; • product visuals and e-commerce images; • product infographics; • interior design concepts; • real estate visuals; • architecture, exterior, and landscape concepts; • virtual clothing try-on; • AI photoshoots; • identity consistency or face profile features; • free-form creative generation; • image animation; • video generation; • other features available inside the service. Futago may add, change, limit, suspend, or remove any feature at any time. Futago may use third-party AI APIs, cloud services, payment providers, hosting providers, infrastructure providers, and other technical solutions required to operate the service. 3. Eligibility and Account Some Futago features may require an account. You agree to: • provide accurate information; • keep your login credentials secure; • not share your account access with unauthorized third parties; • promptly notify us if you suspect unauthorized access to your account. You are responsible for actions taken through your account, unless you can show that such actions were not caused by you or your failure to secure your account. You must be legally able to accept these Terms in your country or region. If you use Futago on behalf of a company or organization, you represent that you have authority to bind that company or organization to these Terms. 4. Acceptable Use You may use Futago only for lawful purposes and in accordance with these Terms. You must not: • use Futago to violate any law; • upload or use content that you do not have the right to use; • upload images of other people without a lawful basis and required consent; • impersonate another person without permission; • create, upload, generate, or distribute content that infringes copyrights, trademarks, publicity rights, privacy rights, or other third-party rights; • use Futago for fraud, deception, scams, harmful activity, or illegal purposes; • attempt to bypass technical limits, payment systems, security systems, or access controls; • use bots, scripts, scraping, automated abuse, or mass account creation without permission; • interfere with the service, infrastructure, AI providers, payment providers, or other systems used by Futago; • use Futago to create unlawful, abusive, misleading, hateful, sexually exploitative, or otherwise prohibited content. We may suspend, restrict, or terminate access if we believe that you violated these Terms, abused the service, created risk for Futago or others, or used Futago in an unlawful or harmful manner. 5. User Content “User Content” means any content that you upload, submit, generate, edit, publish, or otherwise use through Futago. User Content may include: • photos of people; • face images; • full-body photos; • product images; • clothing, shoes, and accessory images; • interiors, rooms, real estate objects, architecture, exterior, or landscape images; • screenshots; • reference images; • text prompts; • product names, descriptions, benefits, and characteristics; • generated and edited results; • any other materials uploaded, submitted, or created by you. You are responsible for your User Content. You represent and warrant that: • you have all necessary rights, permissions, licenses, and consents to upload and use your User Content; • your User Content and your use of Futago do not violate any law or third-party rights; • you have a lawful basis and required consent to upload images of any person; • you have the right to use any product images, brand elements, packaging, logos, interiors, real estate images, reference images, or other materials you upload; • your use of generated results will comply with applicable law and third-party platform rules. If you upload images of another person, minors, third-party products, brand assets, real estate objects, interiors, reference images, or any materials owned by others, you are solely responsible for having the required rights and permissions. You grant Futago a limited license to use, store, process, transmit, display, and technically handle your User Content only as necessary to operate the service, provide requested features, generate or edit outputs, ensure security, provide support, enforce these Terms, and prevent abuse. 6. Face Images and Identity Features Some Futago features may allow you to upload photos of yourself or another person for: • one-time image generation or editing; • virtual clothing try-on; • AI photoshoots; • preserving visual similarity; • identity consistency or face profile features, if available. You are responsible for ensuring that you have the legal right and required consent to upload and use any face image or image of a person. Futago does not guarantee exact likeness, identity preservation, body shape, age, facial details, clothing details, or other personal features in generated results. AI-generated outputs may differ from the uploaded photos. 7. AI Results and Limitations Futago uses artificial intelligence technologies. You understand and agree that AI-generated, AI-edited, AI-animated, and AI-video results may differ from your expectations. Results may: • not fully match your text prompt; • not fully match the uploaded reference; • differ from the source image; • contain visual artifacts; • contain errors in details, proportions, text, logos, colors, objects, clothing, face, hands, fingers, background, or other elements; • differ from the actual appearance of a product, clothing item, interior, real estate object, landscape, or person; • contain inaccuracies in virtual clothing try-on, including fit, size, material, length, shape, texture, print, or details; • contain inaccuracies in product infographics, e-commerce visuals, interior concepts, architecture concepts, or real estate visuals; • contain errors in animation or video, including distortions of motion, objects, faces, hands, text, or background; • be unsuitable for your specific commercial, advertising, marketplace, design, real estate, or other purpose. Futago does not guarantee that any result: • will meet your expectations; • will be unique; • will be legally suitable for commercial use; • will be accepted by marketplaces, advertising platforms, social networks, app stores, or other third-party platforms; • will comply with any specific third-party requirements; • will be fit for a particular business, product, listing, campaign, design, or project. You are responsible for reviewing and verifying all results before using, publishing, selling, advertising, or submitting them to any third-party platform. A result not matching your personal preference, artistic expectation, business goal, or platform requirement is not by itself a guaranteed basis for a refund if the operation was processed. 8. Paid Features, Access Packages, Balance, and Credits Futago may offer paid access, subscriptions, credits, balance packages, usage packages, or other paid features. A package may include: • a certain amount of usage; • an internal balance for using Futago features; • credits or similar internal units; • bonus credits or bonus balance; • additional features; • other terms shown in the service interface at the time of purchase. Any balance, credits, package amount, or similar value shown inside Futago is intended only for use inside Futago. It is not a bank account, deposit, stored-value account, electronic wallet, payment account, money transfer service, or financial product. It cannot be freely withdrawn, exchanged for cash, or used outside Futago. If a balance is shown in a currency, this is used for convenience and internal calculation of service usage. It does not mean that Futago provides a financial account or money storage service. 9. Using Paid Features The price of an operation or feature is shown in the service interface, pricing page, checkout page, or account area. Charges may apply to: • image generation; • image editing; • result improvement; • product visuals; • product infographics; • virtual clothing try-on; • real estate visuals; • interior design concepts; • architecture, exterior, or landscape concepts; • image animation; • video generation; • identity consistency features; • other available features. A charge may be deducted when you confirm, start, submit, or otherwise request the paid operation. If an operation has been submitted for processing, started, or performed using AI models, third-party APIs, compute resources, storage, infrastructure, or other Futago resources, the corresponding part of your package, balance, or credits may be considered used in whole or in part. 10. Bonuses, Promotions, and Free Credits Futago may provide free credits, welcome balance, promotional credits, bonuses, discounts, trial access, or special offers. Such bonuses and promotional amounts: • are not cash; • cannot be withdrawn; • cannot be exchanged for money; • are not refundable; • may be used only inside Futago; • may have an expiration period; • may be changed, limited, revoked, or discontinued at any time. 11. Expiration of Packages and Balance A purchased package, including any balance, credits, or internal usage amount, may have an expiration period. Unless otherwise stated in the service interface, pricing page, or purchase conditions, a purchased package is valid for 45 calendar days from the date of purchase. During the validity period, you may use the available package balance or credits for Futago features. After the validity period expires, Futago may restrict access to the unused portion of the package or remove the unused balance or credits from the account as part of technical account maintenance. Such removal does not mean that money is being debited from your bank account and is not a separate payment transaction. You are responsible for using your purchased package within the applicable validity period. Futago may, but is not required to, notify you before a package expires. Free credits, welcome balance, promotional credits, bonuses, and discounts may have separate expiration rules. 12. Refunds You may contact us at support@futagoapp.com regarding refund questions. Refunds may be considered depending on: • the nature of the purchased digital service; • applicable consumer protection laws; • the portion of the package already used; • operations already started or processed; • third-party AI API costs; • compute and infrastructure costs; • payment processing fees; • bonuses, discounts, and promotional credits; • fraud, abuse, or misuse concerns; • other relevant circumstances. Charges for completed operations and operations that have already been submitted for processing are generally not refundable, except where required by law or where the failure was caused by a technical error on Futago’s side. Refunds may be considered if: • an operation was not performed due to a technical failure on Futago’s side; • you were charged by mistake; • you did not receive a result due to a service failure; • a refund is required by applicable law. The following situations are not by themselves guaranteed grounds for a refund: • you did not like the result; • you expected a different artistic style; • the AI model produced artifacts, inaccuracies, or visual errors; • you uploaded unsuitable, low-quality, or unclear materials; • your prompt or instructions were incomplete, unclear, or unsuitable; • the result did not meet the requirements of a marketplace, advertising platform, client, or business use case; • you did not download the result before the storage period expired; • you changed your mind after the operation was completed. Bonus credits, welcome credits, promotional credits, and discounts are not refundable or exchangeable for money. If a refund is approved, it will generally be issued through the original payment method, unless another method is required or reasonably available. 13. Storage of Uploaded Materials and Results Futago does not guarantee permanent storage of uploaded materials or generated results. Uploaded source images, reference images, screenshots, and other materials used for generation or editing may be stored only for a limited time necessary to process your request, support retries, display results, prevent abuse, and maintain service quality. Such materials may be automatically deleted, including within 24 hours after upload or processing. Generated and edited results may be stored in your account for a limited period, including up to 15 days, unless another period is stated in the service interface. You are responsible for downloading and saving any results you want to keep. Futago is not responsible for loss of access to uploaded materials or generated results after expiration of the storage period, deletion by you, automatic deletion, technical cleanup, service updates, service failures, or discontinuation of features. 14. Rights to Generated Results Subject to these Terms, you may use generated results for personal or commercial purposes. You are responsible for ensuring that your use of generated results complies with applicable law, third-party rights, and third-party platform rules. Futago does not guarantee that generated results are unique or that similar results will not be generated for other users. Futago does not claim exclusive ownership of your generated results, except for Futago’s own service elements, software, interface, brand, logos, design, and other materials owned by or licensed to Futago. You grant Futago a limited right to store, process, display, and technically use generated results as necessary to operate the service, provide support, ensure security, enforce these Terms, prevent abuse, and maintain product functionality. 15. Public Gallery and Publication Futago may offer a public gallery or public feed of user-generated results. Futago does not automatically publish your uploaded source images or generated results without an explicit action from you. A result may be published only if you choose to publish it through the service interface, for example by clicking a “Publish” button, enabling a publication option, submitting content through a publication form, or otherwise clearly confirming publication. If you publish a “before / after” result, you also allow Futago to display the relevant source image as part of that selected publication, only in the form shown in the publication interface. By publishing a result, you confirm that: • you allow Futago to display the selected result in the public gallery; • you understand that the published image may be visible to other users and website visitors; • you allow Futago to use the published result to demonstrate the service, including display outside the Futago website; • you have all rights and consents required to publish the image; • if the image contains a person’s face, likeness, or identifiable features, you have the legal right to publish it. You may request removal of a published result by contacting us at support@futagoapp.com. 16. Futago Intellectual Property All rights to Futago’s software, website, interface, design, brand, logo, technology, text, layout, systems, and other service elements belong to Futago or are used under license. You receive a limited, non-exclusive, non-transferable right to use Futago in accordance with these Terms. You must not: • copy, reproduce, modify, resell, rent, lease, or distribute Futago’s software or service elements; • reverse engineer, decompile, or attempt to extract source code; • use Futago branding in a misleading way; • create a competing service by copying Futago’s interface, workflows, or proprietary materials; • use Futago beyond the access granted under these Terms. 17. Third-Party Services Futago may rely on third-party providers for AI models, payment processing, hosting, storage, analytics, email delivery, authentication, security, monitoring, and other technical functions. Your use of Futago may involve processing by such third-party services. Futago is not responsible for third-party service outages, delays, policy changes, restrictions, or errors, except where required by applicable law. Third-party websites, tools, or services linked from Futago are governed by their own terms and privacy policies. 18. Service Availability Futago is provided on an “as is” and “as available” basis. We do not guarantee: • uninterrupted or error-free operation; • availability of all features at all times; • compatibility with all devices, browsers, or systems; • absence of delays, failures, or technical errors; • continued availability of third-party AI APIs, payment providers, hosting providers, storage providers, or other infrastructure; • that any feature, model, scenario, or tool will remain available permanently. We may: • change features; • introduce limits; • change prices; • change available models; • suspend operations temporarily; • perform maintenance; • update the interface; • restrict access to features; • discontinue features, models, modes, or scenarios. 19. Disclaimer of Warranties To the maximum extent permitted by applicable law, Futago disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability. We do not warrant that: • AI results will be accurate, complete, or error-free; • results will meet your expectations; • outputs will be legally or commercially suitable; • outputs will be accepted by any third-party platform; • the service will be uninterrupted, secure, or available at all times. Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you. 20. Limitation of Liability To the maximum extent permitted by applicable law, Futago will not be liable for: • indirect, incidental, special, consequential, exemplary, or punitive damages; • lost profits; • lost revenue; • lost data; • loss of business opportunity; • inability to use results; • consequences of using generated content; • third-party claims related to your content or outputs; • rejection of content by marketplaces, advertising platforms, social networks, clients, or other third parties; • AI model errors; • third-party provider failures; • network failures; • temporary unavailability of the service; • results not matching your expectations. You are responsible for evaluating the suitability of Futago results for your intended use. Nothing in these Terms limits liability where such limitation is not allowed by applicable law. 21. Indemnification You agree to defend, indemnify, and hold harmless Futago, its owners, officers, employees, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to: • your use of Futago; • your User Content; • your generated results; • your violation of these Terms; • your violation of any law; • your violation of third-party rights; • your use of images of other people without required consent; • your commercial use of generated results; • content you publish or distribute outside Futago. 22. Suspension and Termination We may suspend, restrict, or terminate your access to Futago if: • you violate these Terms; • you violate applicable law; • we suspect abuse, fraud, or misuse; • you attempt to bypass payment or technical limits; • your activity creates legal, security, operational, or reputational risk for Futago; • required by law, payment providers, AI providers, or other third parties; • we discontinue the service or a feature. You may stop using Futago at any time. Termination does not relieve you of obligations that arose before termination, including payment obligations or responsibility for your content and actions. 23. Privacy Our processing of personal information is described in our Privacy Policy. By using Futago, you acknowledge the Privacy Policy and understand how data is processed in connection with the service. 24. Changes to These Terms We may update these Terms from time to time. The updated version will be posted on the Futago website with a new effective date. Changes apply from the date they are posted, unless another date is stated. Your continued use of Futago after changes become effective means that you accept the updated Terms. Changes to prices, packages, features, bonuses, expiration periods, usage costs, and payment rules apply to future purchases and future operations unless otherwise stated. 25. Governing Law and Disputes These Terms are governed by the laws of the Russian Federation, without regard to conflict of law principles, unless mandatory consumer protection laws in your country or region provide otherwise. Before starting formal legal proceedings, both parties agree to try to resolve disputes informally by contacting support@futagoapp.com. If a dispute cannot be resolved informally, it will be resolved in the courts or dispute resolution forum specified by applicable law or by the jurisdiction stated in this section, unless mandatory law provides otherwise. 26.
